This Privacy Policy and Information on Personal Data Processing (hereinafter referred to as the “Policy”) provides information about how TechOne CZ s.r.o., Business ID No.: 060 10 555, with its registered office at Dělnická 213/14, Holešovice, Prague 7, Postal Code 170 00 (hereinafter referred to as “TechOne CZ s.r.o.”) collects, uses, shares, and processes personal data in connection with your use of the website www.techone.cz and TechOne CZ s.r.o.’s social media platforms that reference this Policy.

For TechOne CZ s.r.o., as the operator of www.techone.cz, the professional provision of services is of the highest priority. Equal emphasis is placed on the protection of personal data of its clients, collaborators, and website visitors. TechOne CZ s.r.o. processes personal data in accordance with:

TechOne CZ s.r.o. has not appointed a Data Protection Officer. This information on personal data protection provides TechOne CZ s.r.o.’s clients, visitors to websites operated at www.techone.cz, suppliers, and business partners with information about what personal data TechOne CZ s.r.o. processes about natural persons during website visits and contacts with potential clients, for what purposes and for how long such personal data is processed, and to whom and for what reason TechOne CZ s.r.o. may transfer personal data to other entities. Through this information on personal data protection, TechOne CZ s.r.o. also informs about what rights natural persons have in connection with the processing of their personal data.

The Regulation defines personal data as any information relating to an identified or identifiable natural person (hereinafter referred to as the “data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person (hereinafter referred to as “data”). In connection with the operation of websites at www.techone.cz, TechOne CZ s.r.o. processes the following personal data about natural persons:

  • Processes related to client or potential collaborator identification – contract performance,
  • Fulfillment of statutory tax obligations – fulfillment of legal obligations,
  • For fulfillment of cooperation obligations with state authorities, for purposes specified by special laws for criminal proceedings – fulfillment of legal obligations,
  • Evaluation of client payment history for purposes of preventing receivables, which may affect TechOne CZ s.r.o.’s decision on concluding or not concluding another contract – legitimate interest,
  • Debt collection and other client disputes – legitimate interest,
  • Securing evidence in case of need to defend TechOne CZ s.r.o.’s rights – legitimate interest,
  • Debtor records – legitimate interest.

In the case of service purchase, TechOne CZ s.r.o. processes data necessary for contract conclusion, data about the purchased service, and data from communication between the client and TechOne CZ s.r.o. for a period of 10 years from the date of service provision.

In the case of negotiations between TechOne CZ s.r.o. and a potential client or party interested in collaboration, or a visitor to websites operated at www.techone.cz, which did not result in the conclusion of a contract, TechOne CZ s.r.o. processes the provided data for a period of 10 years from the relevant negotiation.

TechOne CZ s.r.o. archives issued invoices in accordance with Section 35 of Act No. 235/2004 Coll., on Value Added Tax, for a period of 10 years from the end of the tax period in which the performance took place.

TechOne CZ s.r.o. processes data for additional purposes based on your consent. With consent, TechOne CZ s.r.o. processes data necessary for approaching clients with suitable marketing offers.

  • Storage of data about typical client behavior when ordering services.

Consent for commercial purposes is provided to TechOne CZ s.r.o. entirely voluntarily and can be withdrawn at any time. This consent remains valid for a period of 10 years from the date of service provision, during which order the consent to personal data processing for commercial purposes was given through websites operated at www.techone.cz, or for a period of 10 years from the date of other provision of consent to data processing for commercial purposes, or until it is withdrawn.

In the case of consent to marketing outreach through electronic contact, TechOne CZ s.r.o. stores, for the period specified in the consent, the contacts that the natural person makes available for the purpose of this marketing outreach with offers of TechOne CZ s.r.o. services. If the natural person has cookies enabled in their web browser, TechOne CZ s.r.o., together with these contacts, stores data from cookies that are placed on the websites, for the purposes of ensuring better operation of websites operated at www.techone.cz and TechOne CZ s.r.o.’s internet advertising.

In the case of voluntary data processing, you are entitled to withdraw your consent to data processing for commercial and marketing purposes at any time.

Sharing of Personal Data with Other Entities

TechOne CZ s.r.o., in fulfilling obligations from contracts, uses specialized and professional services of other entities who, in the case of data transfer from TechOne CZ s.r.o. as the controller of personal data, have the position of personal data processors. Data processing agreements are concluded between TechOne CZ s.r.o. and these processors, which regulate the processors’ obligations for data protection and security. Processors process personal data about natural persons only within the scope of instructions from TechOne CZ s.r.o. and may not use them otherwise.

  • Data subjects can request deletion of their personal data when: a) the data is no longer necessary for the original purpose, b) consent has been withdrawn and no other legal basis exists, c) an objection has been raised against processing, d) the data was processed unlawfully, e) erasure is required for legal compliance, or f) the data requires removal for other legal obligations.

Right to Restrict Processing:

  • Data subjects can request temporary restriction of data processing if they contest data accuracy, object to processing, or need data maintained for legal claims despite it no longer being necessary for the original purpose.

Right to Data Portability:

  • Data subjects can receive their personal data in a structured, commonly used, machine-readable format and have the right to request direct transfer to another controller. TechOne CZ s.r.o. will fulfill such requests unless they would adversely affect the rights of others.

Right to Object:

  • Data subjects may object to processing of personal data based on TechOne CZ s.r.o.’s legitimate interests. TechOne CZ s.r.o. is entitled to continue processing if it can demonstrate compelling legitimate grounds that override the interests, rights, and freedoms of the data subject.

Right to Withdraw Marketing Consent:

  • Data subjects can withdraw consent for commercial communications and marketing at any time. This includes email, phone, or messenger service communications. Cookie preferences can be managed through browser settings.

Right to Not Be Subject to Automated Decision-Making:

  • Data subjects have the right not to be subject to decisions based solely on automated processing, including profiling, which produces legal or similarly significant effects. TechOne CZ s.r.o. does not make automated decisions without human oversight that would have legal consequences for data subjects.

Right to File a Complaint:

Final Provisions

All legal relationships regarding personal data processing are governed by the laws of the Czech Republic, regardless of where access to them is initiated. Any disputes related to data protection between users and TechOne CZ s.r.o. will be resolved by Czech courts.

Users who provide personal data through electronic forms confirm their consent to data processing by their voluntary submission, and TechOne CZ s.r.o. will not process their data without such consent.

TechOne CZ s.r.o. reserves the right to amend these Terms.

These Terms become effective as of July 20, 2020.
